Outlining Schmoutling...

I'm in the library right now doing some outlining. What is outlining you ask? In preparation for final exams, most law students prepare an "outline" of the class materials. This outline contains the basic "black-letter" law as well as the most important cases and the holdings/rules from these cases. It takes A LOT of time to outline since you are synthesizing all of your class notes and reading notes into an organized, condensed version of the class. You can get outlines from 2Ls and 3Ls, but often they have different cases or different professors, so they are of limited use. Also, it's helpful to do your own outlines because you learn the material that much more effectively. Here is a sample of a bit of my Torts outline (still under construction and the formatting might be a bit messed up when I C/P from Word):

VI. Products Liability
a.Restatement 2d, § 402A
i.One who sells any product in a defective condition unreasonably dangerous to the user or consumer or to his property is subject to liability for physical harm thereby caused to the ultimate user or consumer, or to his property, if
1.The seller is engaged in the business of selling such a product, and
2. It is expected to and does reach the user or consumer without substantial change in the condition in which it is sold.
ii. The rule stated above applies although
1. The seller has exercised all possible care in the preparation and sale of his product, and
2. The user or consumer has not bought the product from or entered into any contractual relation with the seller.
iii. Important Cases
1. Greenman v. Yuba Power Products
2. Henningsen v. Bloomfield Motors

P.S. To all of you Eugenians: Missi and I went to Ring of Fire last night for our "date night." If you haven't been there, you definitely need to check it out. Some really great "pan-Asian" cuisine. It reminded me of a poor man's version of P.F. Chang's.

Back from the Coast...

We spent a few days over at the Coast, and upon returning to Eugene I realized that I left my cell phone at the cabin. That allowed me to have a nice drive over to the Coast again on Tuesday with Drew and my friend Cassidy. A few photos attached...
